Homie Terms of Service

These terms are an agreement between you and [TODO: company legal name]
(“we”, “us”) governing your use of Homie — our personal AI assistant app and
the related services at homie.fyi and api.homie.fyi (together, the
“Service”). By creating an account or using the Service you agree to these
terms and to our Privacy Policy.
1. The Service
Homie is a personal AI assistant app for managing tasks and notes, chatting with an AI assistant, running automations, and remembering things that matter to you. Your content is stored primarily on your device; the Service provides the AI processing, accounts, optional end-to-end-encrypted sync and backup, optional sharing with other people and groups, and optional integrations with third-party services you choose to connect (such as Google Calendar, Gmail, your device calendar, and web search providers).
We may improve, change, or discontinue features of the Service over time. If we discontinue the Service or a materially important part of it, we will give you reasonable advance notice where practicable, and the app’s export feature lets you take your data with you.
2. Eligibility
You must be at least [TODO: minimum age — currently 13] years old to use the Service. By using the Service you confirm you meet this requirement. The Service is not directed at children under 13.
3. Your account
You need an account (email and password, or Google sign-in) to use the Service. You are responsible for keeping your credentials secure and for activity under your account. Keep your account email current — we use it for verification, password recovery, and important service notices.
If you enable encrypted sync, your synced data is protected by a passphrase and one-time recovery code that only you hold. We cannot read your synced data and we cannot recover it if you lose both the passphrase and the recovery code. Keeping them safe is your responsibility.
4. Your content
You own the content you create in Homie — your tasks, notes, chats, memories, attachments, and anything you upload or connect. You grant us the limited license needed to operate the Service: to transmit, process (including by the AI models that power the Service), store (for the optional sync and sharing features), and display your content to you and to people you choose to share it with. We claim no other rights in your content, and we do not use your content to train AI models.
You are responsible for your content and must have the rights to use it with the Service.
5. Subscriptions, trial, and billing
- Free trial. New accounts get a 30-day free trial of the Service’s AI features, starting when you first use them. One trial per person. [TODO: trial terms]
- Subscription. After the trial, continued use of AI features requires a paid subscription (“Homie Pro”), billed monthly or annually. Current prices are shown in the app and at checkout. [TODO: pricing/limits page URL]
- Payment via Stripe. Payments are processed by Stripe. By subscribing you authorize recurring charges to your payment method until you cancel.
- Renewal and cancellation. Subscriptions renew automatically at the end of each billing period. You can cancel any time via the in-app billing portal; cancellation stops future renewals and your subscription remains active until the end of the period you have paid for.
- Refunds. Except where required by law, payments are non-refundable and we do not provide refunds or credits for partial billing periods. [TODO: refund policy]
- Price changes. We may change subscription prices; changes apply from your next billing period, and we will notify you in advance.
- Failed payments. If a renewal payment fails, we may suspend AI features until payment succeeds.

6. Fair use and usage allowances
Each plan includes a generous weekly allowance of AI usage, measured technically in processing tokens. If you reach your allowance, AI features pause until the weekly window resets. Allowances and current limits are shown in the app (Account → plan & usage). We may enforce reasonable technical limits to protect the Service from abuse, automation at scale, or usage patterns that degrade the Service for others.
7. AI output — important disclaimer
The assistant is powered by large language models. AI output can be inaccurate, incomplete, outdated, or otherwise wrong, even when it sounds confident.
- Verify important information before relying on it.
- Homie does not provide professional advice. Output is not legal, medical, financial, tax, or other professional advice, and you should consult a qualified professional for such matters.
- You are responsible for actions taken based on the assistant’s output, and for actions you approve the assistant to take on your behalf (for example creating calendar events or running automations). The app asks for your approval before actions with outside effects; review what you approve.
- Automations run on schedules you set and may act while you are not watching, within the capabilities you granted them. Review their capabilities and run history.
8. Third-party services and integrations
Integrations (Google Calendar, Gmail, device calendars, web search providers, payment via Stripe) connect the Service to third parties. Your use of a third-party service is governed by that third party’s own terms and privacy policy, and you are responsible for complying with them. For web search you supply your own provider API key and are responsible for that provider relationship. We are not responsible for third-party services, their availability, or changes they make that affect integrations.
Use of data obtained from Google APIs is described in the Privacy Policy, including its Google Limited Use disclosure.
9. Sharing and groups
If you share notes or tasks with other people or participate in a family/group list, the people you share with can see and (depending on the role you grant) edit that content. You are responsible for what you share and with whom. Content shared with you belongs to the person who shared it; do not misuse it. Owners can revoke access, and you can leave groups, at any time.
10. Acceptable use
You agree not to:
- use the Service for anything unlawful, or to infringe others’ rights;
- attempt to gain unauthorized access to the Service, other accounts, or the systems the Service runs on, or probe, disrupt, or overload them;
- abuse the AI features — including attempting to generate content that is illegal, or using the Service to harass, defraud, or harm others;
- resell, sublicense, or provide the Service to third parties as a service, or use it to build a competing service;
- circumvent usage limits, billing, or technical protections, or share one account across multiple people;
- reverse engineer the Service except where the law permits it notwithstanding this term;
- upload malware or content designed to disrupt the Service or other users.
We may suspend or terminate accounts that violate these rules (section 12).
11. Our intellectual property
The Service — including the app, our servers, design, and branding — is owned by us or our licensors and is protected by intellectual-property laws. We grant you a personal, non-exclusive, non-transferable, revocable license to use the app to access the Service under these terms. These terms do not grant you any right to use our names, logos, or branding.
12. Termination
- By you: you can stop using the Service at any time, and you can delete your account in the app (Account → danger zone). Deleting your account is permanent. Export your data first if you want to keep it.
- By us: we may suspend or terminate your access if you materially breach these terms, if required by law, or if we discontinue the Service. Unless the breach is serious or we are legally prevented, we will try to notify you and give you an opportunity to export your data.
- Sections that by their nature should survive termination (including sections 4 licenses already exercised, 7, 13–16) survive.
13. Disclaimers
The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Service will be uninterrupted, error-free, or that AI output will be accurate or reliable. Some jurisdictions do not allow certain warranty disclaimers, so parts of this section may not apply to you.
You are responsible for maintaining backups of data that matters to you (the app provides export and optional encrypted backup features for this).
14. Limitation of liability
To the maximum extent permitted by law: we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill, arising out of or related to the Service — including damages arising from AI output or actions taken in reliance on it — even if we have been advised of the possibility. Our total aggregate liability for all claims relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim arose or US $50. Nothing in these terms excludes liability that cannot be excluded by law.
15. Indemnification
You will indemnify and hold us harmless from claims, damages, and expenses (including reasonable legal fees) arising from your content, your use of the Service in violation of these terms, or your violation of law or third-party rights.
16. Governing law and disputes
These terms are governed by the laws of [JURISDICTION], without regard to conflict-of-laws rules, and disputes will be resolved in the courts of [JURISDICTION], except where applicable consumer law gives you the right to bring proceedings where you live. 17. Changes to these terms
We may update these terms as the Service evolves. When we do, we will update the effective date above and publish the new version at this address; for material changes we will notify you in the app or by email before they take effect. Continuing to use the Service after changes take effect means you accept the updated terms. If you do not agree, stop using the Service and delete your account.
